1. Definitions of Customer Categories
“Business Customer” WESTERN ENERGY AUTOMATION & REVERSE TRANSFORMATION RELATED ENTITIES and companies
“Special Customer” WESTERN ENERGY AUTOMATION & REVERSE TRANSFORMATION AD- PRIVATE PERSONS WHO DEAL WITH
“Customer” Business Customers and Special Customers
2. Conditions
When the products are purchased, Customer agrees to comply with these terms and conditions (“Terms”), which generally applyto all purchases made from WESTERN ENERGY AUTOMATION and REVERSALCONVERSION.
The use of the Ordered Products is not permitted unless customer agrees to the Terms of The Customer in full.
Deviations from the terms are only valid if both sides sign a separate written agreement here.
Plcwest.com mainly works towards companies and other businesses and customers therefore business customers. Unless otherwise stated, the Terms apply to Business Customers and Private Customers worldwide (excludingthe United States where specialterms and conditions apply)in and out of Belgium. Please note that the law in lgium is a choice of law and is enforced in accordance with the Terms.
If any of the provisions in the Terms are found to be invalid, for any reason, the remaining provisions of the Terms remain in force.
3. Order
Orders are accepted via phone, fax, email, letter or plcwest.com web store.
When plcwest.com approves an order with a written consent, a purchase agreement is made to which the Terms apply. Items Placed May not be used or ordered unless the terms are fully accepted.
An order will make it clear
- company name,
- reference contact, including their contact information,
- billing address and
- delivery address.
The above (i)-(iv) information or requests that should be considered by the plcwest.com must be specified in the order.
4. Price and Payment
plcwest.com prices are usually indicated except for Value Added Tax (“VAT”). If the purchase is in Belcika, VAT will be added at the specified price. Vat will be added if the Business Customer does not have a VAT number regarding other countries in AB. Vat will not be added to sales outside the EU.
All orders are tracked by an invoice, regardless of the payment method.
plcwest.com only accepts the following payment methods: Bankgiro, IBAN, PayPal and debit/credit cards. Card payments use the DIBS payment system, which allows payment with Visa and MasterCard in EUR, GBP and USD. American Express EUR is available for USD payments. In the event of a card transaction, the terms are applied automatically as soon as the Card transaction is approved.
Customer can choose between ten (10) or thirty (30) days of net payment by invoice. Austria, Belgium, Canada, Czech Republic, Denmark, Estonia, Faroe Islands, Finland, France, Germany, United Kingdom, Greenland, Hungary, Ireland, Italy, Japan, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Rumania, Switzerland, Slovakia, Slovenia, Spain, Sweden, USA.
5. Title and Risk Reservation
All Products remain sole and exclusively owned by plcwest.com until full payment is received. The risk for the product is forwarded to the Customer after shipment of the Product.
6. Delivery
plcwest.com ambition is to deliver orders as soon as possible. Orders are usually sent on the same day or the day after orders are received. Special delivery arrangements can be agreed in case of emergency.
6.1 Freight Damages
If a product from plcwest.com is damaged during carriage, the carrier will be immediately notified by the customer within seven (7) days after delivery is received, regardless of whether the damage is visible.
6.2 Cancellation
Business Customers do not have the right to cancel or withdraw an order unless otherwise agreed.
In Belcika, Private Customers are entitled to withdraw the order within 14 (fourteen) days of receipt of the Products (and in accordance with other national laws) under the Belcika Distance Contracts Act. The right to withdraw is valid only if the Products and original packaging can be returned to the plcwest.com in a substantially unchanged condition. The products should not have been used. If a Private Customer grants the right to withdraw the order, you must contact the Private Customer plcwest.com to obtain a return form. Freight costis paid by customer.
The right to cancel or the right to withdraw does not apply to the Products made or purchased specifically for the customer in accordance with the customer’s characteristics or other requirements.
7. Product
7.1 Availability of The Product
Products are either used or supposedly new redundancy. Therefore, Products are distributed as specified in the product classification in Section 7.2 below.
Products are purchased from businesses and/or individuals who have purchased spare parts from disposed machines. No Product is derived from a generic agent.
Customer carries risks in the installation and/or installation of the Products and assumes sole risk and liability in the event of other potential damages, including job interruption, loss of equipment, data and personal data, and indirect or incidental damages. plcwest.com is not guaranteed by normal wear and tear, incorrect installation/installation, or use of the Products for a purpose where they are not designed, or if the Products violate third-party rights.
The products will be established and assembled by customer in a professional manner and in accordance with the manufacturer’s recommendations and guidelines. plcwest.com is not responsible for any damages that may occur as a result of the wrong, non-professional or negligent processing, establishment or installation of products.
7.2 Product Category
plcwest.comuses the following terminology for product categories:
New redundancy: The product may be connected, but it has never been commissioned. The product can be in its original sealed packaging, original packaging opened or in its own packaging of plcwest.com.
As new: A Product that is normally used for demonstration purposes and therefore ordered for a very short time.
Used : A device previously used, for a specific product, good working status. Covers and other parts that have nothing to do with the functionality of the Product may be missing.
Not nice, there may be minor damage : a product with cosmetic defects that have nothing to do with the functionality of theproducts. Normally plastic or slight rust damage.
The cover is missing : but the cover in which the loading guide is written isused as it is missing.
Unperfect display : Operator panel where the display is more damaged than you would expect from asecond-hand device in good working conditions.
Otherwise, in this case, they can also use other categories to be specifically specified.
7.3 Quality Control
Products are subject to limited functionality control as long as plcwest.com has knowledge and capability.
7.4 Limited Warranty
plcwest.com, the defect can replace the Product witha similar Product in the same product category. plcwest.comreserves the right to replace the Product with an equivalent Product if there isno same Product.
If the fix or replacement is not a possible option and the error is considered important to the Customer, the Customer may terminate the order. However, upon this termination, customer does not have the right to any compensation (including damages) or other alternative remedies other than the reimbursement of the amount paid for the Product in question. The product must be returned to plcwest.com upon termination.
Plcwest.com’s liability for defects is limited only to correction and termination in accordance with this Section.
Private Customers have special rights that may apply under the Belcika Consumer Sales Act and in accordance with other national laws.
